Terms and Conditions of Use

 

The website www.chardon.paris (the "Website" or the "Site") is published and administered by Les Editions Jomont SASU, a simplified joint stock company (Société par Actions Simplifiée) (hereinafter referred to as "LEJ"), headquartered at 20 rue des Fossés, 35000 Rennes, France, with a share capital of €7,500, registered with the Registre des Sociétés de Rennes under number 852 023 472.

The use of the Site and the purchases of products offered on the Site are subject to these General Conditions of Use (hereinafter the "General Conditions of Use"). By using the Internet Site Chardon.paris, the Customer recognizes to have read, understood and accepted without reserve the present General Conditions of Use.

LEJ may modify and update these Terms and Conditions at any time. The General Terms and Conditions of Use in force at the time of use of the Website are those which are enforceable against the Customer.



1. Intellectual and Industrial Property

All of the elements (illustrations, images, typefaces, presentation methods, graphics, typefaces, texts, logos, brands, etc.) making up the Website are and remain the exclusive property of LEJ or of the holders of the said rights who have granted LEJ the right to use them. The reproduction or representation of these elements without the express prior written consent of LEJ constitutes an act of infringement punishable under the Intellectual Property Code and the Criminal Code.

The trademark "CHARDON PARIS", all other trademarks and logos related to LEJ, whether registered or not, displayed on the Website, as well as the domain name "Chardon.paris" are and shall remain the exclusive property of EMC, SARL registered with the Commercial Court of Rennes under number 444 469 852, President of LEJ.

The Customer may not remove any copyright, trademark or other proprietary rights notices from the Website or any content contained therein. The Customer may make a single copy of the web pages published on the Website for the Customer's own private, personal, non-commercial use, provided that any copy of such web pages retains all copyright and proprietary notices contained therein.

 

2. Personal Data and Cookies

The information and data concerning the Customer are strictly necessary for the management of orders, the execution and follow-up of commercial relations, as well as for internal statistical purposes.

This data may be transmitted to companies involved in these relationships (such as those responsible for the execution of services and orders) for their management, execution, processing and payment. This data is also kept for the purposes of security, identification, improvement and personalisation of services.

The Customer's bank details are never in our possession. Transactions are processed entirely by the secure payment module of our partner Stripe.

The Customer has the right to access, rectify and object to personal data concerning him/her at any time. This right can be exercised by contacting our Customer Service by e-mail at bonjour@chardon.paris.

The Customer may receive offers from LEJ concerning products or services similar to those or the one already ordered, or newsletters. The Customer may at any time object to this at no cost in the future, in accordance with the terms and conditions specified in each mailing.

The Website uses cookies (connection cookies), which the user is informed of when he/she arrives on the Website, which enable information relating to the computer's navigation on the Website to be recorded. These cookies are installed only after acceptance by the user, the continuation of the navigation on the Website being considered as acceptance. The user may oppose the use of these cookies by configuring his browser, knowing that access to certain services may require prior acceptance by the user of cookies.

 

3. Links

The Site may contain links to third party sites not maintained or controlled by LEJ. Such links are provided solely as a convenience and cannot and should not be construed as an express or implied endorsement of those sites, their content or any products or services offered therein.

A user may only set up a link to the Site with the prior and express written permission of LEJ.

 

4. Limitation of Liability

In no event shall LEJ be liable to any user, Customer or third party for any indirect, incidental, special or consequential damages, including, without limitation, any lost profits or other indirect losses, arising out of the user's use of or inability to use the Site. This limitation of liability applies to the fullest extent permitted by law.

 

5. No Guarantee

The Website may contain technical inaccuracies or other defects and LEJ does not warrant that these defects will be corrected. The Website and its contents are provided "as is" and "as available". LEJ expressly excludes any form of warranty, in particular any implied warranty relating to the usual conditions of use of the Website or the suitability of the Website for normal use or for a specific purpose, its quality or compliance with any legal provisions. This limitation of liability applies to the fullest extent permitted by law.

 

6. Applicable Law - Disputes

These General Conditions of Use are governed by and interpreted in accordance with French law in accordance with EC Regulation 593/2008 of 17 June 2008. These General Conditions of Use are written in French.

In the event of a dispute relating to the use of the Website, the user has the possibility of resorting to a conventional mediation procedure or to any other alternative dispute resolution procedure.

In the event of a dispute, in accordance with the provisions of Regulation 44/2001 of 22 December 2000:

- the user may bring the matter before the court of his place of residence or before the French courts,

- LEJ may bring the matter before the court in the place where the user is domiciled.

LEJ reserves the right to seek and obtain injunctions or orders in defence of its rights hereunder.

In the event of discrepancies between the French and English versions of the General Terms of Use, the French version shall prevail.
